Flight Attendants may be disciplined or terminated for advocating for self-help outside of the Railway Labor Act process
As negotiations continue, our top priority is addressing membership concerns when we return to the bargaining table. In the meantime, we must be careful (whether on social media, WhatsApp, texting or in person) about how we talk about negotiations and avoid unlawful self-help against the Company.
Under the Railway Labor Act, we cannot engage in “self-help” until we are released by the National Mediation Board following a thirty day cooling-off period. The National Mediation Board has discretion over whether to grant a release to strike. What this means is at this stage we are not able to engage in any self-help and individual Flight Attendants may be disciplined or terminated for advocating for self-help outside of the Railway Labor Act process.
Illegal Self-help includes, for example:
- Coordinating sick-outs
- Discouraging picking up open time
- Refusing to perform duties or “working to rule”
We have a lawful path to reach an agreement that involves sending a clear message to the Company that you all are fired up and ready for a contract that does not put individual Flight Attendants at risk. Our solidarity is our power and together we will negotiate an agreement that demonstrates our significant contributions to Alaska Airlines.
